Acknowledgment of Risk

I, the undersigned, acknowledge that participating in the fitness workshop ("Workshop") hosted by InHabit involves inherent risks. These include the potential for physical injury, property damage, or, in rare cases, death. Risks may arise from the physical demands of exercise, the use of equipment, or interactions with other participants.

I understand that I am responsible for monitoring my own well-being during the Workshop. If I experience discomfort, dizziness, pain, or any other issue, I will immediately stop participating and inform the instructor.

By signing this waiver, I confirm that I voluntarily choose to participate in the Workshop and accept all associated risks, including those that may arise from the negligence of InHabit or its agents, except where prohibited by law.

Liability Waiver

I agree to release and discharge InHabit, including its employees, instructors, agents, representatives, and affiliates, from any and all liability, claims, demands, or actions related to any injury, loss, damage, or death I may experience during my participation in the Workshop.

This waiver does not limit any rights I have under Australian Consumer Law (ACL) or exclude claims arising from injuries caused by gross negligence or intentional misconduct. InHabit is fully accountable for damages resulting from such circumstances.

Health and Medical Disclosure

I confirm that I am in good health and capable of participating in the Workshop. I understand that it is my responsibility to disclose any medical conditions, injuries, or limitations that may affect my ability to safely engage in Workshop activities. Examples include, but are not limited to, heart conditions, joint issues, pregnancy, or mental health concerns.

If my health status changes before or during the Workshop, I agree to notify InHabit immediately. Upon disclosure of any condition, InHabit will review the information and assess whether my participation poses a risk to myself or others. If participation is deemed unsafe, InHabit reserves the right to restrict or deny participation, and this decision will be communicated to me promptly.

Assumption of Risk

I acknowledge that participating in physical fitness activities, such as strength training, cardio exercises, and other activities in the Workshop, carries inherent risks. These include the possibility of injury or harm caused by my own actions, the actions of others, or unforeseen circumstances.

By signing this waiver, I voluntarily assume all such risks and agree that InHabit is not responsible for any injury, loss, or damage unless caused by gross negligence or willful misconduct.

Photo and Video Consent

I understand that InHabit may take photographs, videos, or other recordings during the Workshop for promotional, marketing, and social media purposes. By signing this waiver, I grant my consent for InHabit to use these images or recordings that include me.

If I prefer not to be photographed or recorded, I agree to notify the instructor before the Workshop begins or at the start of the session. InHabit will make reasonable efforts to honor my request and ensure I am excluded from any imagery.

I waive any rights to royalties, payments, or prior approval of the final materials if I consent to being photographed or recorded.

Refund and Cancellation Policy

I acknowledge that the Workshop fee is non-refundable, except where required by law. If I need to cancel my participation, I must notify InHabit at least 48 hours before the Workshop’s scheduled start to receive a full refund.

If I cancel within 48 hours of the Workshop or fail to attend, I understand that no refund will be provided.

Parental Consent (for Minors)

If the participant is under 18 years of age, I, as their parent or legal guardian, give my full consent for their participation in the Workshop. By signing this waiver, I accept all terms and conditions on behalf of the minor and take full responsibility for any risks or injuries associated with their involvement.

Indemnity

I agree to indemnify and hold harmless InHabit, its directors, officers, employees, agents, and affiliates from any claims, damages, or expenses (including legal fees) resulting from my participation in the Workshop. This includes third-party claims arising from my actions or negligence.

Emergency Medical Treatment

In the event of an emergency where I am unable to make decisions regarding my medical care, I authorize InHabit to obtain medical treatment on my behalf. I agree to bear all reasonable and necessary costs associated with such care, including transportation and treatment fees, to the extent these costs are not covered by my insurance.

Acknowledgment and Acceptance of Terms

By agreeing to the terms and conditions at booking, I confirm that I have read, understood, and voluntarily agreed to all terms and conditions outlined above. I understand that this waiver is a legally binding document.

I acknowledge that this agreement does not limit my rights under Australian Consumer Law or exclude claims arising from gross negligence or intentional misconduct.

I accept full responsibility for my participation in the Workshop.
